Terms of Service

Read these terms carefully before using ClearPath Disputes.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ClearPath Disputes ("Company," "we," "us," or "our"). By creating an account or using any part of the ClearPath Disputes platform (the "Platform"), you agree to be bound by these Terms in their entirety.

IMPORTANT — PLEASE READ: By using this Platform, you acknowledge that ClearPath Disputes is a self-serve document creation tool. We do NOT provide credit repair services, legal advice, or financial counseling. You are solely responsible for all data you enter and all documents you generate. Use of generated documents is entirely at your own risk.

1. Nature of the Platform

ClearPath Disputes is a self-serve document creation platform that provides software tools for generating dispute letters and correspondence based on data that you manually enter. Specifically:

  • We are not a credit repair organization as defined under the Credit Repair Organizations Act (CROA), 15 U.S.C. §1679 et seq.
  • We are not a law firm and do not provide legal advice or legal representation
  • We are not a credit counseling agency or financial advisor
  • We do not contact credit bureaus, creditors, or collectors on your behalf
  • We do not guarantee any particular outcome from the use of documents generated by our platform
  • We do not access, retrieve, or scrape your credit reports — all data is manually entered by you

Our Platform simply provides templates and tools that facilitate your exercise of rights that already exist under federal law, including the Fair Credit Reporting Act (FCRA, 15 U.S.C. §1681) and the Fair Debt Collection Practices Act (FDCPA, 15 U.S.C. §1692).

2. User Responsibility & Assumption of Risk

YOU BEAR FULL AND SOLE RESPONSIBILITY FOR:

  • The accuracy, completeness, and truthfulness of ALL data you enter into the Platform
  • Reviewing, verifying, and approving ALL documents before sending them to any party
  • Determining whether a dispute is factually warranted based on the information in your actual credit reports
  • Compliance with all applicable federal, state, and local laws when using generated documents
  • Any consequences, outcomes, or responses resulting from your use of generated documents
  • Maintaining the security and confidentiality of your account credentials
  • All activity that occurs under your account

You acknowledge that the Platform generates documents based solely on the data you provide. If your input is inaccurate, incomplete, or fraudulent, the resulting documents will reflect those deficiencies. ClearPath Disputes assumes zero liability for the content, accuracy, or effectiveness of any document generated based on your input.

3. No Guarantee of Results

ClearPath Disputes makes absolutely no representation, warranty, or guarantee that:

  • Any negative information will be removed from your credit reports
  • Your credit score will improve
  • Credit bureaus or creditors will respond favorably to your disputes
  • Any particular legal or financial outcome will result from use of our Platform

As the Federal Trade Commission (FTC) clearly states: "No one can legally remove accurate and timely negative information from a credit report." Our Platform assists you in exercising your right to dispute inaccurate information — it cannot and does not promise the removal of accurate information.

4. Mandatory Truthfulness

You agree that all disputes initiated through our Platform will be based on genuine, factual inaccuracies in your credit reports. You specifically agree that you will NOT:

  • Submit frivolous or bad-faith disputes
  • Dispute information that you know to be accurate
  • Make false claims of identity theft
  • Use the Platform to harass creditors or credit bureaus
  • Misrepresent your identity or any material fact
  • Use the Platform for any illegal purpose

Violation of this section may result in immediate account termination without refund and may be reported to appropriate authorities.

5. CROA Compliance Notice

Credit Repair Organizations Act (15 U.S.C. §1679) Disclosure:

You have the right to dispute inaccurate information in your credit report by contacting the credit reporting agency directly. However, neither you nor any "credit repair" company or credit repair organization has the right to have accurate, current, and verifiable information removed from your report.

Under the FCRA, the credit bureau must remove inaccurate or unverifiable information from your file, usually within 30 days after receiving your dispute.

You have the right to obtain a copy of your credit report from a credit bureau. You may be charged a reasonable fee. There is no fee if your report has been denied credit within the preceding 60 days, or if you are unemployed, on public assistance, or believe your file contains errors due to fraud.

6. Indemnification

You agree to indemnify, defend, and hold harmless ClearPath Disputes, its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use or misuse of the Platform
  • Any documents you generate, send, or distribute using the Platform
  • Any data you enter into the Platform
  • Your violation of these Terms
  • Your violation of any applicable law, regulation, or third-party right
  • Any complaint, claim, or legal action brought against us by any credit bureau, creditor, collector, or other party as a result of your actions

This indemnification obligation shall survive the termination or expiration of your account and these Terms.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE
  • WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
  • WE ARE NOT LIABLE FOR ANY ACTIONS TAKEN BY CREDIT BUREAUS, CREDITORS, COLLECTORS, OR ANY OTHER THIRD PARTY IN RESPONSE TO DOCUMENTS GENERATED USING OUR PLATFORM

8. Subscription, Fees & Refund Policy

Free Tier: Limited to one (1) generated document. No credit card required.

Paid Plans: Monthly and Annual subscription plans provide unlimited document generation and additional features. Pricing is displayed on our Pricing page and is subject to change with 30 days' notice.

Refund Policy: Due to the digital nature of our services and the immediate delivery of generated documents, all sales are final. No refunds will be issued for partially used subscription periods. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

9. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Submitting frivolous or fraudulent disputes
  • Making false claims of identity theft
  • Using the Platform for illegal purposes
  • Attempting to reverse-engineer, hack, or abuse the Platform
  • Circumventing usage limits or security measures

Upon termination, all data associated with your account will be deleted in accordance with our data retention policy. No refunds will be issued for accounts terminated due to Terms violations.

10. Intellectual Property

All content, software, code, designs, templates, and documentation comprising the ClearPath Disputes platform are the exclusive intellectual property of ClearPath Disputes and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of our Platform without express written consent.

11. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved through binding individual arbitration in accordance with the rules of the American Arbitration Association (AAA). You agree that:

  • All disputes shall be resolved on an individual basis only — class actions, class arbitrations, and representative actions are expressly waived
  • The arbitration shall be conducted in the state of our principal place of business
  • The arbitrator's decision shall be final and binding
  • Judgment on the award may be entered in any court of competent jurisdiction

12. Governing Law & Severability

These Terms shall be governed by and construed in accordance with the laws of the State in which ClearPath Disputes is incorporated, without regard to its conflict of law provisions.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered users and by updating the "Last Updated" date. Your continued use of the Platform after the effective date of any changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, your sole remedy is to discontinue use of the Platform and delete your account.

If you do not agree to these Terms, do not create an account or use the Platform.
